Terms & Conditions

1) Agreement

By using ALLWATERS or booking a rental (the “Services”), you accept these Terms and our Privacy Policy. If you do not agree, please don’t use the Services.

2) Eligibility & operator requirements

  • Renter must be 18+; operators must meet Florida boating requirements and carry valid government ID.

  • Where Florida law requires, boating safety certification must be presented. We reserve the right to refuse service if legal requirements are not met.

3) Safety rules (summary)

  • Wear a U.S. Coast Guard–approved PFD at all times.

  • No alcohol, drugs, or impaired operation.

  • Obey speed/no-wake zones and keep safe distances from people, docks, wildlife, and other vessels.

  • Follow staff instructions and local regulations; violations may end the rental with no refund.

4) Reservations, pricing & payment

  • Prices, fees, taxes, deposits, and optional delivery are shown at checkout.

  • You authorize us and our payment partners to charge your selected method for rental fees, add-ons, taxes, and any post-rental charges (fuel, late returns, damage, cleaning, lost gear) as described in your agreement.

5) Security deposit & post-rental charges

A refundable deposit may be held to cover incidentals. You’re responsible for damage (beyond ordinary wear), excessive cleaning/sand intrusion, missing equipment, and late-return fees per your rental agreement.

6) Weather

If unsafe marine conditions are declared by staff (e.g., lightning, small-craft advisories), we’ll reschedule or refund per the Refund Policy below. Light rain or heat does not automatically qualify.

7) Equipment condition & telemetry

You’ll inspect the craft before departure and note any issues. Where fitted, GPS/telemetry is used for safety, theft prevention, and compliance with operating zones.

8) Title & risk

Title remains with us. You assume risk of operation once the safety briefing and hand-off are complete, subject to our negligence exceptions under applicable law.

9) Prohibited uses

No towing without written permission, no beaching in prohibited areas, no night operation, no subleasing or lending, and no operation outside permitted zones.

10) Liability; disclaimers

Except as required by law, the Services are provided “as is” and “as available.” To the maximum extent permitted, ALL WATERS JET SKI RENTALS LLC is not liable for indirect, incidental, special, consequential, or punitive damages. Our aggregate liability will not exceed the amounts you paid for the rental at issue.

11) Indemnity

You agree to indemnify and hold us harmless from claims arising out of your breach of these Terms, unlawful conduct, or negligent operation of the craft.

12) Changes; governing law

We may update these Terms at any time. Continued use after changes take effect constitutes acceptance. These Terms are governed by the laws of Florida, with exclusive venue in Lee County, Florida.
